These terms of use (“Terms”) govern your access to and use of the Clea N. mobile application (the “App”) provided by Gredis Ventures GmbH (“we”, “us” or “our”). By accessing or using the App, you agree to be bound by these Terms.
1. Applicable Terms
These Terms, along with any additional terms and conditions provided within the App, constitute the entire agreement between you and us regarding your use of the App. If you do not agree to these Terms, you must not use the App.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for your personal, non-commercial use. You must not reproduce, modify, distribute, or create derivative works of the App.
3. Refund Policy
If you have purchased the application via the App Store and wish to request a refund, please manage this through your account with Apple, as all transactions are processed directly through Apple's systems. To initiate a refund, follow the instructions provided in your Apple account settings.
If your purchase was made directly through our website, you may request a refund by contacting us at hello@clea.coach. Please include your order number and the email address used for the purchase in your request. Refunds on website purchases can be requested within 14 days of the transaction date, provided that the service has not been utilized extensively.
4. User Content
You may have the opportunity to submit or post content, such as comments or feedback, through the App (“User Content”). By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.
You represent and warrant that you have the necessary rights and permissions to grant us the above license and that your User Content does not violate any applicable laws or infringe upon the rights of any third party.
5. Prohibited Conduct
When using the App, you must not:
4.1. Violate any applicable laws, regulations, or third-party rights.
4.2. Use the App in a manner that could disable, overburden, or impair the functioning of the App.
4.3. Interfere with or disrupt the security or integrity of the App or any related systems.
4.4. Attempt to gain unauthorized access to the App or any related systems.
4.5. Use the App for any unauthorized or illegal purposes.
4.6. Impersonate or misrepresent your affiliation with any person or entity.
6. Intellectual Property Rights
The App, including its content and underlying technology, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved by us. You must not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on the App.
7. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with the use of the App, even if we have been advised of the possibility of such damages.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.
10. Modifications to the Terms
We reserve the right to modify or update these Terms at any time without prior notice. Your continued use of the App after the posting of any changes constitutes your acceptance of the modified Terms.
